Terms of Service

By using Mist in any way, you accept these Terms and agree to comply with them. If you use Mist on behalf of a server or organization, you confirm that you have the authority to bind that server or organization to these Terms.

These Terms form a contract between you and the Mist team. If any part is unenforceable where you live, the rest still applies.

You must be at least 13 years old to use Mist, matching Discord's minimum age. If you are between 13 and the age of majority where you live, you confirm that a parent or guardian has reviewed and accepted these Terms on your behalf.

You must have a valid Discord account and comply with Discord's own Terms of Service and Community Guidelines at all times while using Mist.

We grant you a limited, non-exclusive, non-transferable, revocable license to use Mist for your own Discord servers and personal use. This license does not give you ownership of Mist or any rights to copy, resell, or redistribute it.

You may not reverse engineer Mist, extract its source code, scrape the dashboard, or use it to build a competing product. You may not use Mist in a way that violates Discord's terms or applicable law.

The dashboard requires you to sign in with Discord. You are responsible for keeping your account secure and for everything done through it.

If you manage a server's settings on the dashboard, you confirm you have permission to do so. Abuse of server settings, such as changing permissions you do not hold, is a violation of these Terms.

You agree not to use Mist to break the law, harass others, or disrupt services. Prohibited behavior includes, but is not limited to:

Using commands to raid, spam, or harass users or servers. This includes repeated automated abuse of economy, autopost, or image services.

Attempting to gain unauthorized access to Mist, our servers, or other users' data. This includes probing for vulnerabilities, testing limits in an abusive way, or interfering with rate limits or cooldowns.

Using Mist to store or transmit illegal content, malware, or content that infringes someone else's rights.

Interfering with the normal operation of Mist, including deliberately triggering crashes, excessive load, or denial-of-service conditions.

Creating multiple accounts or servers to evade a ban, a cooldown, or a limitation we have applied.

Mist offers user-install app commands that work outside of a specific server. When you install Mist as a user app, you control where those commands can be used, and you may uninstall them at any time from your Discord user settings.

You are responsible for how user-install commands are used in conversations where you are present, and you should only use them in places where you have permission and where their behavior is welcome.

The dashboard includes Misty, an AI assistant. Misty can answer questions about the server you have open using data you can already access, and can prepare certain settings changes for you. Misty never applies a change by itself: every change is shown to you as a confirmation and is only written after you accept it.

Misty can make mistakes and may return inaccurate or incomplete answers. Its responses are not professional advice and should be verified before you rely on them. You are responsible for any settings you confirm.

Do not use Misty to attempt prompt injection, to extract its instructions or any credentials, or to change settings you are not authorized to change. Access is enforced by the dashboard itself, and misuse may lead to your access being suspended.

Misty is powered by third-party language models. Your prompts and the relevant server data may be sent to that provider to generate a response. See the Privacy Policy for how this is handled.

Mist offers optional premium subscriptions: Server Premium, which unlocks features for a server you manage, and User Premium, which unlocks features for your user account.

Premium is billed in advance, monthly or yearly, through Discord's monetization system. Subscriptions renew automatically until you cancel them. You can manage or cancel your subscription through your Discord settings.

Premium features are provided on an as-is basis and do not change the data or privacy terms that apply to you. See our Refund Policy for details on charges and refunds.

Mist includes commands that can moderate a server, such as warnings, bans, kicks, and mutes, as well as economy, autopost, and image services. The person with permission to run these commands in a server is responsible for how they are used.

Mist performs actions only when a permitted command is run or a configured automation triggers. We are not responsible for how server owners or moderators use these tools, and we do not arbitrate disputes within a server.

We work to keep Mist reliable, but we do not guarantee that it will be available at all times or error-free. Mist may be unavailable for maintenance, upgrades, or due to failures outside our control, including Discord outages.

To the maximum extent permitted by law, we are not liable for any loss you suffer because Mist is unavailable, is slow, or fails to execute a command, including lost economy balances, missed autoposts, or failed moderation actions.

Mist, including its name, logo, code, and design, is owned by the Mist team and is protected by intellectual property laws. Your data and content remain yours; these Terms do not transfer ownership of them.

Nothing in these Terms gives you any right to use Mist's trademarks or branding, except as needed to link to us or describe that you use Mist.

Mist depends on Discord to operate. Your use of Discord is governed by Discord's own terms and privacy policy, which we do not control. When Discord is unavailable or changes its platform, some Mist features may stop working.

Mist may link to third-party services such as our documentation or support server. We are not responsible for the content or practices of those third parties.

To the maximum extent permitted by law, Mist and its team are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of Mist or these Terms.

Our total liability to you for any claim arising out of these Terms or your use of Mist will not exceed the amount you paid us in the 12 months before the claim, or $50, whichever is greater. This limitation applies even if we were advised of the possibility of such damages.

You may stop using Mist at any time by removing it from your servers, uninstalling the user app, and deleting your dashboard account.

We may suspend or terminate your access to Mist if you violate these Terms, abuse the service, or if required by law. Where possible, we will try to give you notice, but we may act immediately when needed to protect the service or other users.

On termination, we may delete data associated with your account or server as described in our Privacy Policy. Sections of these Terms that should survive, such as the limitation of liability, will continue to apply.

We may update these Terms from time to time. We will update the "Last updated" date at the top of this page and, where practical, notify you through the dashboard or Discord.

Your continued use of Mist after changes take effect means you accept the updated Terms. If you do not agree, stop using Mist and delete your data.

These Terms are governed by the laws of the jurisdiction in which the Mist team is established, without regard to its conflict-of-law rules.
